After viewing the clip and reading the case brief, answer the following questions in 1-2 double-spaced pages. What does the 5th Amendment say about eminent domain? Why was it included in the Constitution?
- Describe the three methods of “public use” for which the U.S. Government could take private property prior to the Kelo Supreme Court Decision. Explain how the Kelo Supreme Court decision altered the use of eminent domain by the U.S. government. Do you think it’s fair for the U.S. Government to have this power? Explain your position.
